TERMS OF USE

Welcome to the TalkEncourage Mental Care Provider Booking System (hereinafter referred to as "System"). This document outlines the terms and conditions that govern your use of the System, including the collection and processing of your personal data. By accessing or using the System, you agree to comply with and be bound by these terms and conditions. Please read this document carefully before using the System.

Conditions of use

By using the system, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the system accordingly. The management of TalkEncourage only grants use and access of this website, its system, and its services to those who have accepted its terms.

1. Registration and Account:

To book a mental care provider through the System, you are required to register for an account. You agree to provide accurate, complete, and up-to-date information during the registration process. You are solely responsible for maintaining the confidentiality of your account information, including your username and password. Any actions taken under your account will be your responsibility.

You must be at least 18 (eighteen) years of age before you can use this system. By using this website, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement. TalkEncourage assumes no responsibility for liabilities related to age misrepresentation.

We reserve all rights to terminate accounts that violate the terms of this agreement.

2. Requesting Prosecutor's Clearance:

By using the System to book for a mental care provider, you acknowledge that the information you provide is accurate and truthful. False or misleading information may lead to legal consequences.

3. Data Privacy:

We are committed to protecting your privacy and personal data in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules and regulations. By using the System, you consent to the collection, use, and processing of your personal data in the manner described below:

  • 3.1. Collection of Personal Data:

    We will collect personal data from you during the registration process and while using the System. This may include, but is not limited to, your name, contact information, government identification details, and other relevant information necessary for processing your prosecutor's clearance request.

  • 3.2. Use of Personal Data:

    Your personal data will be used for the purpose of processing your prosecutor's clearance request and related administrative purposes. Your data may be accessed by authorized personnel within the Quezon City Prosecutor's Office for verification, approval, and communication purposes.

  • 3.3. Data Security:

    We implement appropriate technical and organizational measures to safeguard your personal data against unauthorized access, disclosure, alteration, or destruction. However, no data transmission over the internet is completely secure, and we cannot guarantee the security of your data.

  • 3.4. Data Retention:

    Your personal data will be retained only for as long as necessary to fulfill the purposes for which it was collected or as required by law. After this period, your data will be securely deleted or anonymized.

4. Freedom of Information:

While your personal data is protected by the Data Privacy Act, certain information related to TalkEncourage’s booking process and the System's operation may be subject to the principles of freedom of information. Requests for such information may be made in accordance with applicable laws and regulations.

5. Intellectual Property:

The content, design, graphics, and other elements of the System are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on any part of the System without our prior written consent.

6. Limitation of Liability:

We strive to provide accurate and reliable information through the System, but we cannot always guarantee its accuracy or availability. We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the System.

7. Disputes:

Any disputes or claims arising from or related to the use of the System shall be resolved through negotiation and mutual agreement. If a dispute cannot be resolved amicably, you agree to submit to the exclusive jurisdiction of the courts of the Republic of the Philippines.

8. Indemnification:

You agree to indemnify and hold TalkEncourage, its officers, employees, and affiliates harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the System, violation of these terms and conditions, or infringement of any rights of a third party.

9. Modifications and Termination:

We reserve the right to modify, suspend, or terminate the System at any time without prior notice. We also reserve the right to update these terms and conditions as needed. Continued use of the System after any modifications constitutes your acceptance of the updated terms.

10. Governing Law:

These terms and conditions are governed by the laws of the Philippines. Any disputes arising from or related to the use of the System shall be subject to the exclusive jurisdiction of the courts of the Republic of the Philippines.

By using the TalkEncourage Mental Care Provider Booking System, you acknowledge that you have read, understood, and agreed to these terms and conditions, including the provisions of the Data Privacy Act. If you do not agree with these terms, please refrain from using the System.
